LEGAL
Our Report: After withdrawing his lawsuit against OpenAI in July (accusing it of abandoning its non-profit founding mission), and re-opening it again in August, Elon Musk has now thrown new antitrust accusations and defendants into the mix—including Microsoft, LinkedIn co-founder Reid Hoffman, and ex-OpenAI board member and Microsoft VP, Dee Templeton—and has added support from two new plaintiffs: Neuralink exec and ex-OpenAI board member Shivon Zilis, and Musk’s AI startup, xAI.
🔑 Key Points:
Musk alleges that OpenAI is “trying to eliminate competitors”, such as xAI, by “extracting promises from investors not to fund them” and is unfairly benefitting from Microsoft’s infrastructure, calling it a “de facto merger.”
He argues that Hoffman (who’s on the board at Microsoft, and was at OpenAI, until 2023) has an illicit view of the company's dealings and that Templeton facilitated antitrust violation “agreements between Microsoft and OpenAI.”
He says plaintiff Zilis—the mother of 3 of his kids and ex-project director at Tesla and Neuralink—repeatedly raised concerns over OpenAI’s dealmaking, similar to his own, but they “fell on deaf ears.”
🤔 Why you should care: These amendments strengthen the original premise of the lawsuit: Musk believes that, as one of the initial co-founders of OpenAI, he was coerced into getting involved in the start-up by assurances that it would remain a non-profit that was committed to making safe and transparent AI available for all, but its quickly, in the space of just eight years, become a $157B for-profit subsidiary of Microsoft, and in doing so “violates almost every principle of law governing economic activity,” something which OpenAI has dismissed as blusterous” and baseless.

POLICY
Our Report: The EU has released a 36-page draft Code of Practice, designed to operationalize the landmark EU AI Law (which came into effect in August), serving as a roadmap for tech companies developing ‘General Purpose AI’ (GPAI) to help them bypass penalties for non-compliance, and has asked for stakeholder feedback, with the plan to finalize it by May 2025.
🔑 Key Points:
The draft states that AI companies must use web crawlers that “read and follow instructions expressed by the Robot Exclusion Protocol (robots.txt)” and release information on “data used for training, testing, and validation.”
They must also release the results of testing processes and set up a Safety and Security Framework (SSF) that details their risk management policies to “assess and proportionately mitigate systemic risks.”
Board-level executives must also take accountability for systemic risk, and bring in outside experts to “enable meaningful independent testing and risk and mitigation assessments.”
🤔 Why you should care: AI models released by the likes of OpenAI, Google, Meta, Anthropic, and Mistral, fall under the category of ‘general purpose AI’ and are, therefore, likely to be affected with penalties up to €35M ($44M) or up to 7% of their global annual turnover, whichever is higher, for non-compliance.

Gartner has projected that, by 2027, the power for AI applications will increase by 160%, meaning that 40% of global AI data centers will experience power shortages, leading to “operational limitations.”
This surge in demand for power is expected to disrupt the availability of power on the grid, limiting data center expansion, hampering the scalability of AI projects, and exacerbating carbon emissions.

NASA has partnered with Microsoft to build an AI chatbot—Earth Copilot—that can process NASA’s large-scale geospatial data, turning it into easy-to-understand answers to questions about the planet.
Currently, just scientists and researchers can access and interpret the data within NASA’s database, so Earth Pilot will “democratize” access to important scientific data for the ‘Average Joe’.
Scientists and researchers are currently testing Earth Pilot, but after this, it will eventually be integrated into NASA’s Visualization, Exploration, and Data Analysis (VEDA) platform, which anyone can access.
